New labour law mandates payment of employee salaries even during business shutdown
The Undersecretary at the Social Affairs Ministry and Labour, Mohammad Al-Kandari, said that as per the new labour law for private sector, the owners of commercial establishments and private firms are obliged to pay salaries to employees, even for the period when the business was shut down, if it has been proved that the establishment actually did so to make the employees submit to the demands of the owner.
Al Kandari also said that a business owner has to pay the salaries of employees for the entire period of inactivity, whether wholly or partially, in case the owner wants the employee to continue working.
The last payment received by the employee is taken into consideration for calculations. The dues are determined as average of received payments during the past three months.
Al-Kandari also pointed out that the Ministry, apart from releasing the new labour law, also monitors and constantly inspects commercial establishments and private firms to ensure that all articles of the law are being implemented.
