New labour law protects expats, say experts
The new labour law for private sector in Kuwait has incorporated some positive clauses aimed to improve the conditions of employees and the interests of the employers, pointed out few Law teachers at the Kuwait University.
Speaking during a seminar, the professors agreed that the positive aspects of the new law include protecting expatriate employees from arbitrary retrenchment, control in visa trading, and limiting human trafficking.
One of the professors also pointed out that the law maintains a stable contract, even in cases of change in employers, apart from offering the right compensation to employees in cases of mistreatment. The law protects employees from arbitrary abuse and retrenchment by their employers.
He also pointed out that a clause which prohibits employees from suing employers, unless the Social Affairs Ministry is aware of the case, is also a positive aspect of the law. Such a measure can help in resolving issues amicably than through litigation.
However, they also pointed out that the law neglected the aspect of exploitation of domestic workers and few other such issues. One of them mentioned that the new law did not do anything about the issue of depriving non-Kuwaitis from forming unions, which contradicts the international labour law.
