new labour law hoped to protect expatriate worker rights
The new Labour Law will protect the rights of expatriate workers, revealed the Ministry of Social Affairs and Labour in Kuwait, this week.
In its response to the criticisms by ILO (International Labour Organization), the ministry emphasized that the new law includes a stipulation to settle labour disputes in court, in case the employers and workers fail to resolve the conflicts among themselves.
Plans are also being discussed for passing a regulation on protection of rights of housemaids. The plans also include formation of unions for both employers and workers, including the public sector employees, as per the international agreements signed by Kuwait in 1961.
The Ministry continued to explain that the country lacks regulations that helps make negotiations for public sector workers because they are under the Civil Service Commission (CSC), and the government hears the demands of the workers’ through CSC.
The Ministry revealed that the new labour law permits expatriate workers to join labour unions and vote for the Board of Directors of these unions. At present Kuwait has 55 workers’ Unions and 38 Employers’ Unions.
The new labour law, if passed, would considerably increase the rights and benefits of Kuwaiti and expatriate private sector employees. The employees would be granted longer vacations, more national holidays and greater insurance rights and protections against termination.
The bill is awaiting a second review after amendments, and before granting the final approval for the regulation to be passed.
