Transfer of dependent visa into work visa permissible after one-year stay
The Ministry of Social Affairs and Labour has announced that the labour departments in all governorates will begin accepting applications for transfer of dependent visa into work visa in the private sector, provided, the applicant has stayed in the country for a period of atleast one year.
Earlier, such transfers were permissible only if the dependent had been in the country for three years, or atleast for two years (in the case of graduates).
This decision by the Ministry has been made applicable to all nationalities and professions, irrespective of whether the applicant is a university graduate, or has no qualifications.
But, transfer of the work permit into a family visa can be done only at the discretion of the General Immigration Department (GID) as this issue falls within the authority of the GID.
A visit visa can neither be transferred to family visa or work visa in the private sector, the Ministry said.
There is no specific time frame for transfer of residence permit of domestic workers to work visa in the private sector, as long as they work for the company of the same sponsor or a company owned by first degree relatives of the sponsor – wife, husband, mother, father and children.
It should be noted that the above condition is not applicable to domestics, who entered the country before 1st April 2008. It is a well-known fact that the transfer residence permit of domestic workers to work visa was restricted to same sponsor and the employee should have worked for the sponsor atleast for six months.
